TERMS AND CONDITIONS
These Terms and Conditions govern the contractual relationship between you and Janeiro Tour & Travel.
By booking a tour, you agree to be bound by these Terms and Conditions, it constitutes a contractual agreement between Janeiro Tour & Travel and you from the time the booking is made. The person who makes the booking accepts these conditions on behalf of all the people in the group and is responsible for all payments due.
REQUIREMENTS
At the time the booking is made, you must be 18 years or older to travel with Janeiro Tour & Travel. You are responsible for arranging your own flight to the destination. You are responsible for making sure you meet all of the entry requirements to the country we are visiting.
PAYMENT
Upon receiving your booking request, Janeiro Tour & Travel’ consultants will start to assist you in building your pleasant, enjoyable stay. A booking is only confirmed with the applicable deposit or fully paid tours from the Client and when the Client has received written confirmation from us of such booking. Janeiro Tour & Travel give you the option to pay in full or choose the payment plan option. A guarantee of a full payment is required at the time of booking for all bookings received within 4 weeks of departure.
Inability to pay on or before the stated option date shall mean auto cancellation of the said booking. Please note that Janeiro Tour & Travel shall not be responsible for bookings that are automatically cancelled due to the lapse or inability to pay on or before the option date.

BOOKINGS SOLD ON A TWIN ACCOMMODATION
Bookings may be accepted where requested on a room-share basis on the condition that the person/s requesting the room-share reservation agree that although every effort will be made to comply with requests regarding age, non-smoking etc... this is not always possible and we accept no responsibility for any incompatibility between persons sharing rooms. No guarantee is given that a shared room will be found. If a shared room is not available at the time of final payment, either the single room alternative or the cancellation conditions set out below will apply to you
ONLINE BOOKINGS
All online reservations shall be deemed as booked in Brazil, and shall be subject to Brazilian law and jurisdiction.
TRAVEL INSURANCE
Travel insurance is not included in the price of the tour and all medical costs and other costs involved must be paid by the client. It is therefore strongly recommended that clients get personal insurance. We encourage the clients to seek their doctor’s advice regarding necessary or advisable vaccinations, medical precautions, or other medical concerns regarding their stay. Clients must notify us in writing prior to the due date of their final payment for their booking of any medical conditions, pregnancy, disability or any other mental and or physical condition which may impact the Client’s fitness to travel, and/or any continuing medical condition.
CANCELLATION AND REFUND POLICY
Any cancellation of a booking by a Client must be notified to Janeiro Tour & Travel in writing and be acknowledged by Janeiro Tour & Travel in writing. Deposits are non-refundable and non - transferable between persons. This package is transferable to other person.
Payments made beyond the initial deposit are refundable is subject to the following cancellation fees:
High Season: * Carnival, Christmas, New Years, December and January.
- 60 days or more before departure - loss of deposit
- 59 to 45 days before departure - 50%
- 44 to 15 - 80%
- Within 14 days of departure - no refunds.
Low Season:
- 30 days or more before departure - loss of deposit
- 29 to 15 days before departure - 30%
- 14 to 07 days before departure - 50%
- Within 07 days of departure - no refunds.
No refund for No Show or on The Spot cancellation. No refund for unutilized nights, including those resulting from delayed check-in or early check-out.
Janeiro Tour & Travel will not cancel a booking once confirmed, in accordance with these Terms, except for reasons of ‘Force Majeure’, which shall be defined as unusual or unforeseen circumstances outside of the reasonable control of Janeiro Tour & Travel. When a tour is cancelled by Janeiro Tour & Travel before the agreed date of departure for reasons not arising from the fault or negligence of or within the reasonable control of the Client, the Client shall have the choice of: accepting a substitute tour of equivalent value, where such substitute is reasonably available or refund of all monies paid for the cancelled tour.
RISK & LIABILITY
Every effort is made to ensure that your holiday arrangements are satisfactory and we accept liability for, but only to the extent of, any loss or damage sustained by you as a direct result of our negligence. In any event, our aggregate liability to you is limited to the amount you have paid to us for the relevant tour. You acknowledge and agree that there are inherent risks involved in participating in the tour, including without limitation possible contact with native fauna, local residents, unforeseen events and travel in remote locations. By making a booking, you agree to accept all risks associated with the tour.
Janeiro Tour & Travel is not responsible for any incidental expenses or consequential losses that the Client may have incurred as a result of the cancelled booking such as visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc. Where, after departure, a significant element of the Services as described cannot be provided, Janeiro Tour & Travel will make suitable alternative arrangements for the continuation of the trip. If it is not possible to provide a suitable alternative or the Client reasonably rejects any suitable alternatives, Janeiro Tour & Travel will provide the Client with a refund of unused Products or Product portions. If we or our service providers are affected in any way by a force majeure event, we may in our discretion vary or cancel any itinerary or arrangement in relation to the tour as we consider necessary, without incurring any liability to you.
AMENDMENTS
Janeiro Tour & Travel reserves the right to update and/or alter these Terms at anytime, and shall post the amended Terms on the Janeiro Tour & Travel website (www.blacktravelers.com). The latest Terms, as amended, may be accessed any time on Black Traveler’s website, or will be sent to Client upon their written request to Janeiro Tour & Travel.
IMAGES AND MARKETING
The Client agrees that while participating in any Janeiro Tour & Travel product images, photos or videos may be taken by other Clients and/or Janeiro Tour & Travel representatives. The Client acknowledges that they consent to any such pictures being taken and agree that the Client hereby grants a perpetual, royalty-free, worldwide, irrevocable license to Janeiro Tour & Travel, its affiliates and assigns, to reproduce for any purpose whatsoever (including marketing and promotions), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation to the Client or compensation payable to such Client.
